By using the treadXchange app or website ("treadXchange", "we", "us") you agree to these terms. If you do not agree, do not use the service.
treadXchange is a neutral platform that connects buyers and sellers of used tires, and lists repair shops that install them. We are not the seller or the buyer in any transaction and we never take title to inventory. The description, condition, legality, and fitness for use of any tire are the responsibility of the seller. Whether to buy is the responsibility of the buyer.
treadXchange is free to use. We do not charge listing fees, transaction fees, commissions, or subscriptions, and the app contains no purchases. If we introduce paid features in the future we will update these terms and give notice before any charge applies.
We do not process, hold, escrow, or transmit payments. Buyers and sellers arrange payment and handoff directly between themselves, on whatever terms they agree, using whatever method they choose. treadXchange is not a party to that arrangement and provides no payment protection, guarantee, refund, or dispute resolution. Any dispute over money, condition, or delivery is between the buyer and the seller.
You must be at least 18 years old to create an account. One person, one account. You are responsible for what happens under your account and for keeping your credentials secure.
Sellers must describe tires accurately, including tread depth, age (DOT date), and any repairs or damage. Photos must be of the actual tires being sold. Tires below the safe and legal tread threshold for road use must not be listed for road use. Buyers should inspect tires in person before paying.
Used tires are a safety-critical part. Age, storage, internal damage, and prior repairs are not always visible. treadXchange does not inspect, test, certify, or verify any tire, and a listing appearing on our platform is not a representation that the tire is safe or roadworthy. Have any used tire inspected by a qualified professional before it goes on a vehicle.
Transactions happen in the physical world. Meet in a public place, bring someone with you when you can, and use your judgment. treadXchange does not screen, background check, or vet users, and is not responsible for the conduct of any user, online or off.
You agree not to misrepresent items, post content you do not have the right to post, harass or threaten other users, post unlawful, fraudulent, or sexually explicit content, scrape or abuse the service, or use it for anything illegal. We may remove content and suspend or terminate accounts that violate these terms, with or without notice.
Every listing and every user can be reported from inside the app, and any user can be blocked. Reports go to a moderation queue that we review. We remove content and remove accounts at our discretion when we find a violation.
You keep ownership of the photos and text you post. You grant treadXchange a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content for the purpose of operating and promoting the service. You can delete your content or your account at any time from the app.
The service is provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by law, treadXchange is not liable for the condition, safety, legality, or performance of any tire transacted between users, for the conduct of any user, or for any indirect, incidental, or consequential damages. Where liability cannot be excluded, it is limited to one hundred United States dollars.
We may update these terms. Material changes will be posted here with a new "last updated" date. Continuing to use the service after a change means you accept it.
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law rules.
